If enough players reject the settlement the judge may decide to reopen talks between the players and the league however there isn't a threshold for it to happen.
There are some who believe there is a chance that the judge Paul Magnuson, will be able to decide whether or not to bring both sides back to the bargaining table. When Magnuson approved the Madden NFL 24's settlement offer in April, he stated:
"It is worth repeating: the individuals who originally brought this suit and who currently oppose the settlement walked into court with the intention of helping their poor brethren, those who had played for the N.F.L. but today were in dire straits and, often, being afflicted by injuries or illness directly related to their play. It's a sign of irresponsibility for these plaintiffs today to say of being like children who were denied dessert that the settlement "does not make enough money for the plaintiffs who brought the suit."
Participants who do not opt out of the settlement have the option of filing individual lawsuits against the league. They might be more likely to do so as a result of the recent news in O'Bannon's vs. NCAA case, too and now that former college athletes are suing over the way in which their names are that is being used in video games.
In July In July, in July, the Ninth Circuit threw out an appeal brought by video game producer EA Sports. The decision dismissed the argument from EA that likenesses of players were protected by the First Amendment and it will let the case proceed.
The Dryer plaintiffs are following that matter closely. They're also observing another lawsuit, filed by thousands from former Madden NFL 24 players, over the issue of concussions.
"I believe there's an apparent connection in the atmosphere here," Dryer said of the two instances. "The Madden NFL 24 is scrutinizing very capriciously and in a smug manner at the concussion issues.
"There's the preconceived notion [from"the Madden NFL 24"game"] that "we're going to take that.' going to accept that.' There's an air of arrogance there."
Dryer is hoping that something will work out, and that he along with his former teammates can come to a settlement with Madden NFL 24 which will directly compensate them for the use of their likeness and leave them with ownership rights over it.
"I have a lot of deals based on my image as an actor as well as a producer" Dryer said. "My appearance is my professional. It's my identity. Every person has a brand, and every person has a right to move their brand in a direction they want.
